Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Fullsurf.com website, billing portal, and email services (together, the “Service”), operated by Fullsurf (“Fullsurf”, “we”, “us”, or “our”). By using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Eligibility & Account Registration

To use the Service, you must be able to form a binding contract and comply with these Terms. You are responsible for the accuracy of information you provide during signup and for keeping your contact and billing details up to date.

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. If you believe your account has been compromised, please contact us immediately at support@fullsurf.com or by phone/text at 808-582-2552.

2. Description of Service

Fullsurf provides hosted email accounts under the @fullsurf.com domain, including webmail access at full.surf, IMAP/SMTP connectivity, spam filtering, and related customer support. Service features, limits, and pricing are described on this website and may be updated from time to time.

We may make changes to the Service (including improvements, bug fixes, or modifications to infrastructure) at any time, provided that such changes do not materially reduce the core functionality of your paid plan without notice.

3. Acceptable Use

You agree not to use the Service for any unlawful, abusive, or harmful purpose, including but not limited to:

We reserve the right to investigate potential violations and to suspend or terminate accounts that engage in prohibited activities or that put our infrastructure, reputation, or other customers at risk.

4. Billing, Renewals & Cancellations

Paid plans are billed in advance, typically on a yearly basis, as described on the Pricing page and in the billing portal. By purchasing a plan, you authorize Fullsurf (or our payment processor) to charge your selected payment method for the applicable fees.

Unless otherwise stated, subscriptions renew automatically at the end of each billing period at the then-current rate, until you cancel through the billing portal or by contacting support. You are responsible for cancelling before the renewal date if you do not wish to continue service.

Fees are generally non-refundable, except where required by law or explicitly stated otherwise. In certain cases (such as promotions or trial periods), additional terms may apply and will be communicated at the time of signup.

5. Priority Support

If you enable optional Priority Support, additional terms and limits may apply, including changes to your yearly charge limits and a non-refundable charge for the first month, as described in the Priority Support section on the main site and within the billing portal.

6. Service Availability & Maintenance

We aim to provide a reliable and stable Service, but we do not guarantee that the Service will be uninterrupted or error-free. From time to time, we may perform maintenance (scheduled or emergency), during which the Service may be temporarily unavailable.

We are not responsible for outages or issues outside our reasonable control, including those caused by third-party network providers, data centers, or upstream carriers.

7. Data & Privacy

We strive to respect your privacy and do not use your mailbox content for advertising or data resale. Our handling of personal information is described in our separate Privacy Policy, which is incorporated into these Terms by reference.

You are responsible for keeping your own copies of any important data. While we may use backups and redundancy to protect the Service, we do not guarantee that deleted or lost messages can always be recovered.

8. Intellectual Property

The Fullsurf name, logo, website design, and underlying software are owned by Fullsurf or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain all rights to the content you send or store using the Service. You are solely responsible for ensuring that you have the necessary rights to use and transmit such content.

9. Disclaimers & Limitation of Liability

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Fullsurf and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Service.

In all cases, Fullsurf’s total liability for any claim related to the Service will be limited to the amount you paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Suspension & Termination

We may suspend or terminate your access to the Service if you violate these Terms, use the Service in a way that creates risk or possible legal exposure for us or other customers, or if we are required to do so by law.

You may stop using the Service at any time. Termination does not relieve you of any obligation to pay any unpaid fees, and we do not guarantee refunds for unused service periods unless required by law.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by updating the Effective Date above and, where reasonable, by posting a notice on this website or emailing you. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
